From Russ Diamond...

Thank you for reaching out to me. I share your concerns about the integrity of Pennsylvania's recent election, because of the actions taken by the PA Supreme Court, the Secretary of the Commonwealth, and election officials in certain counties in the weeks prior to the election. I believe these actions have resulted in a failed election to appoint presidential electors.

3 U.S. Code § 2 states "Whenever any State has held an election for the purpose of choosing electors, and has failed to make a choice on the day prescribed by law, the electors may be appointed on a subsequent day in such a manner as the legislature of such State may direct."

I, along with 21 other members of the House of Representatives, have circulated a co-sponsorship memo for a joint resolution for the General Assembly to exercise its plenary authority to appoint presidential electors for Pennsylvania, in response to the failed election.

Read the co-sponsorship memo: https://www.legis.state.pa.us/cfdocs/Legis/CSM/showMemoPublic.cfm?chamber=H&SPick=20210&cosponId=33462

I have also joined 31 of my colleagues in submitting a letter to Vice President Pence detailing the very troubling issues surrounding the presidential election here in Pennsylvania and imploring him to reject the slate of electors from Pennsylvania when he presides over the joint session of Congress to count the Electoral College votes on January 6. You can download and read that letter for yourself at: https://drive.google.com/file/d/1bkP-2UFZNUQbZdPIGUWAt65rezKV5I4Q/view?usp=sharing

Beyond the presidential election issue, we have asked the Governor for a full audit of the election and to convene a special session of the General Assembly to address these matters. In addition, we are exploring all other avenues available to the General Assembly to ensure faith in Pennsylvania's election results.

With all that said, I am committed to pursuing every available avenue within my authority to ensure every legal vote is accurately accounted for - in every Pennsylvania election.
