From my understanding, the issue with Jefferson was with him counting what appeared to be an illegitimate electoral vote submission from Georgia (ironic, I know) which gave him the Presidency, not that he discarded electoral votes.

With Nixon, the governor signed stating Nixon won, but a full count showed Kennedy won. Both sets of electoral votes were delivered to Washington as part of the electoral process. Nixon chose to use the "Kennedy" votes because they were the "accurate" results of the election, not the one the HI governor submitted.

Not trying to muddy the waters, but this current situation is different than the ones you mentioned, although the more recent Nixon situation is probably the better example of the two. These examples do demonstrate that the VP does have the legal authority to selectively choose which electoral votes to count.

So at the George HW Bush funeral, all the Bush clan and former presidents and their wives were there, and the whole thing was broadcast live. Youtube has pretty much scrubbed parts (or at least made it not show up when searched for) where people such as Hillary open the Programme folder, and out falls a weird envelope. All of the people on center stage got an envelope. People say that Pence got one too. What is written on these letters? Who knows. Are they the same letter or different? Again, unknown.

At one point in the funeral, Laura Bush finds her envelope. She goes huh, what's this, and opens and reads it when they're carrying GHWB's casket out. She nudges Jeb! and Jeb! takes a look at the letter. He immediately looks like a man who just died inside.

Nothing, but that’d be a good thing. The founders never intended on the POTUS being elected by the general public. They wanted him elected by a sample of Americans plucked from across the fields and countrysides of the nation. That pretty quickly failed as State Legislatures balked and decided to hold “elections” and gave control of nominations to the parties... and that’s how we got stuck with a two-party system.

Well, the founders left a fallback Plan B which is one of those fallbacks that’s probably better than the Plan A.... The States vote. The VP can throw out envelopes, but he can’t add votes to push someone over 270. All he can do is push it to congress.

Well... a State-by-State vote is good. Its better than we’re doing now. Also better than trusting a “random” group of Americans who’d easily be corrupted and targeted and god knows what else.

It's all derived from "the votes shall then be counted", a passive voice phrase that doesn't really tell you much about what the process is supposed to look like. There's also zero precedent for a VP to exercise any discretion over the vote count over the objections of Congress.

I think the play is to just do it anyway and see if the resulting chaos works out somehow.

Not true. Thomas Jefferson did it and became president because of that (He was VP at the time and counting his own votes). Nixon did not count his own certified elector votes from Hawaii in 1960 and instead chose JFK's non-certified votes. Certification didn't matter at all. If it had, then Nixon would have been required to count the votes for himself.

Jefferson didn’t cast aside any electors in 1800. It was a tie, with no one having a majority of electoral votes so it went to the House. The House held 35 ballots and were tied between Jefferson and Burr. Hamilton intervened and convinced Federalists to back Jefferson and lots of people changed to Jefferson or Abstained and Jefferson won. Jefferson didn’t do any ballot picking or choosing in the election of 1800. It WAS controversial though.

You don’t understand the context. He can’t “overturn an election” and nobody is saying that. It’s not supposed to be a clean process every time. This stuff was written hundreds of years ago.

The idea is that the VP certifying results is the final signal of accepting a transition - a member of previous administration counting votes and accepting results. Basically it is the moment for the population to watch and see if both sides agree that everything has been above board. Everyone has to work together to make it happen - all the state level reps, the outgoing admin via VP, and the incoming admin via president elect.

It’s the moment where, if something is fucky, the majority population has the opportunity to take their 1A and 2A and act before the inauguration date. By this point in time, we the people are supposed to be satisfied with the results and procedures en masse. If we aren’t, we are expected to do - exactly what Trump has asked. Show up. Be heard. Be seen. And if required, be ready to do something.

This is all playing out exactly as it is supposed to, historically, other than the deep swamp judges and AGs. But the system as written can take care of that shortfall too, assuming people will take their 1 and 2 As seriously.

Yep, the founders assumed that elector’s votes would be secret and thus the ability to reject illegal electors wouldn’t offer the VP any opportunity to effect the election, because the certificates would all be sealed, and he wouldn’t know who the votes were for.

States have thrown out how this is supposed to work by passing laws that attempt to shift the power to the people, and try to control the nomination and voting if the electors. This maneuver both creates an opportunity for fraud which doesn’t exist in the original design, but also a method for curing fraud.

Trump's second term still needs legitimacy.

The much touted 'alternate slates' are backed by small minorities of the legislature from their respective states.

You can't hang your presidency on 20 guys out of 200 voting for you.

Pence needs to reject these states completely. If he can't do that, the cleaner option is to invoke Insurrection Act and go to war.

Picking minority backed electors, he will have no legitimacy at all. I doubt military will back him up than.

I'm probably wrong on this, and hopefully a more knowledgeable pede will correct me, but I thought it went like this;

Jan 6 - In the absence of a majority (270) the House votes to select the president, the Senate votes to select the Vice President.

If there are issues with conflicting electoral votes, the two houses may vote which to accept or reject. If they can't agree, the electors certified by the Governor of the disputed state would be counted.

Again, probably wrong, but hopefully someone chimes in.

Edit - Okay, I feel it's not fair to have others do the hard lifting while I sit here. It turns out it's a state-by-state vote in the House. So not number of sitting congresswomen (this is a thing now, right Emanuel Cleaver?). It's one vote per state. So while Congress is Democrat majority by total seats, the Republicans have this by State vote (California with 55 electoral votes now gets just as much of a say as Montana with 3).

I think I get this now.

I think there are a couple options. He can tell them to fuck off (or rather tear up those ballots), which I think would reduce the number of votes needed to win, handing it directly to Trump. He can also say “hmm, we have two sets of electors here from these states, I don’t know which to choose,” in which case the winning number would still be 270. In that case the president would be elected by the House, and the VP by the Senate.

He's within his rights to resolve the dispute in this manner in the strict sense of it. That will never satisfy our opponents because, in this case, that dispute happens to determine the outcome of the election. Nonetheless, the rule is the rule, and there is no rigid rule I'm aware of that requires him to recuse himself, however much the left may try to say he must.

I think Lin Wood and Pence are both on the up-and-up. I think the letters were a proposed peace deal with the Deep State. Either they refused, or backed out, or Trump never had any intent to honor the deal and wanted to use it as a trap.
