The Supreme court has already ruled, they're just waiting for the case to be filed first. But if it takes too long, they'll file the case themselves.

It's such a subtle wording. If he'd said "The VP has the duty..." I think it would absolutely be a call out. Since he said "The VP has the power...", I read it as justifying the actions to his critics.
