The tweet is misleading. They can't "Ban" him from the city, unless that was part of his bail / release. "We'll let you go if you leave and stay away until your court date". If Enrique agreed to it, then his rights aren't being taken away. He's willingly choosing to leave. He could have decided to stay in jail, or attempt a different bargain. He didn't.
Its how the legal system works, like a bunch of old women coming up with nonsense language. Its twisted and convoluted in order to trap you.
IF the release did in fact say "We'll let you go if you leave and stay away until your court date"...
And if he DID leave jail based on that, then he is making an agreement with the court. He could and I have no doubt they would hold him to that. But its ultimately up to him to go along with it. If caught back in DC and arrested, he could be found violating the court.
In that situation, if it is like generated_name said, then Tarrio would have to reject the release under that stipulation because of violation of constitutional rights and legally call out the judge for violating his rights. But the judge knows that would take substantial time. Also the prosecutor is most likely buddies with the judge and would assist with dragging out modifying the release conditions. They could adjourn for the day, reschedule for a multitude of reasons (omg covids got us again!), go slow with processing the request for adjustment, stall the defense team, or any number of other bullshit tactics to delay.
