Actually, judges can take pre-emptive action in the form of injunctions and writs of mandamus.

if the election officials set out rules ahead of time - yes you could challenge those rules pre-emptively.

But we have no way of dealing with them changing rules at last minute.

act first and let the other side whine to the courts. if courts take their case, you can go defend your actions in court than.
