The vote by delegation is only for situations where there's a stalemate in the race. If Trump can get majority of electoral college votes then joint session would have to certify his win unless both houses voted to object - and right now, the Senate R majority would assist that. Essentially it would be the exact opposite situation as the current one (if allowed to continue)
So if 3 states re-certify which takes Biden under 270 then each state has to vote 1, Repubs hold majority so trump wins. Is this what's likely?
