He was hoping Pence would unilaterally decide the election in an unprecedented and illegal way. Sorry, but that's what it is. For it to work SCOTUS would have to rule the Electoral Count Act unconstitutional AND rule that it's constitutional for the VP alone to discard certified votes. SCOTUS won't even hear his cases, do you think that would happen?

I'm sorry, I know it sounded like a rosy option but it was just never realistic.
