The Suspension Clause of the United States Constitution specifically included the English common law procedure in Article One, Section 9, clause 2, which demands that "The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."
This is a particularly powerful tool for both sides. Be careful.

Im saying nobody gives a shit about the law until the dust has settled in a civil conflict like this. Which is why lincoln did so well dealing with the south and others during the civil war, even when all the lawyers said "that's illegal don't do that"
That's fine and all, unless you're on the shit end of Shays' Rebellion or the Civil War.
Well i would say exhibit A of whether you are on the right side or shit side would be a county by county breakdown of voting.
That's not what I mean by shit side - I mean being on the losing end of any civil war, no matter who had the morally sound position.
