Further, I think It may have been a negligent discharge if it was the cop closest in SWAT gear. He wasn't looking in her direction when the shot was fired.
EDIT: Watching it again (i'm done with that) the shot wasn't nearly loud enough to be right next to the camera recording. This is even worse if it came from ~35 yards down the hallway. Zero chance even with Police discretion shooting justified.
They at worst have 1/3 things needed. Ability (mob/riot) the murderer will say he didn't know cops were already with them. He still didn't have Opportunity or Intent.
Ability: Does the person have the actual physical means to seriously injure or kill me?
Opportunity: Too far, he had plenty of time to give commands.
