The only argument you could possibly make for it, is that the guy was ordered to hold with lethal force since it's a very high level government building but even then if you watch his conduct it's just wrong. It was clearly a decided shot to make, and it was chosen to be lethal. He steps up, unprovoked aims and kills her. Disgusting.
When shooting you're not trained to target the neck are you?
What I mean by unintended is he probably was going for a body shot, but as she was ducking down to get through the window she probably changed the intended target of his shot. If you watch the clip from infowars you can see as you hear the gunshot, she was already in a forward downward motion, and when she's hit she freezes and falls backwards.
Something like shooting a woman in the doorway of her home holding a baby in her arms. The shooter was never held accountable, but the husband overcame the charges which led to the siege of their HOME which led to their deaths.

Yeah I heard, never confirmed though, that Nancy gave the order to use lethal force.
