Have you been a US resident for at least five of those six years together? I've been through the process, also with a strained marriage for a little while (thank the Lord we figured things out better), and for a little while I had to consider applying solo. I'm betting you're familiar with it all already, but yeah if you're here five years legally in any capacity, you no longer need to apply specifically as a spouse.
