Here’s a good analysis of the VP power to cast aside votes: he MAY have the power. It has never really been done before, and the Constitution is vague.

Know what that means? You exercise the power - and let the courts sort it out. You don’t give up and give in. You play the card you’re dealt.

Pence’s actions yesterday were indicative of him being nothing more than a grade a swamp rat. It took 4 years to reveal, but there it is.

Any time there is a "question" about legality, it is always for the Courts to decide. No one said "Pence is forbidden from decertifying". It was always "We don't think he has the power." That ambiguity is enough for Pence to act - and have the Courts figure it out.

He signlehandedly could have forced the Courts to hear about his authority, and the unresolved fraud. The question before the Court would have been "Can a state certify, in accordance with Constitutional regulations, if there are ongoing fraud claims?" That is how the VP could rule on these matters - when EC ballots are non-conforming.

He torpedoed us on purpose. There is no other way to look at it.
