Why did they shoot Ashli?

Why isn't the cop who did it up for murder charges? He shot an unarmed person in the back of the neck. Why? The more I review it and think about it it becomes more clear this shit is fake

  1. nervous untrained LE and "mob" is now crossing the line into the zone to defend - Did not shout any warning and neither did the police on Ashli's side (they were all right there and in the stairwell) - BTW: plain clothes LE are not usually untrained.
  2. bad apple, politically motivated LE or other Capitol worker that took the opportunity to shoot someone once it could be justified
  3. somebody shouted "gun" - maybe he panicked and took out the first intruder
  4. Hollywood bullshit that is beyond my knowledge or even imagination for purposes I do not yet understand
