People like to bash this but I think with some legal thought it's a great avenue for opposition. Charles Murray (the Bell Curve guy) wrote an entire book on the topic of civil disobedience through similar means called By The People: Rebuilding Liberty Without Permission. People need to be thinking about this for real.
