That being said, in the UK we use BBC Radio 4s LW frequency as our emergency broadcast frequency. It's why a sizeable chunk of that frequency band is left open.
Anyway my point is it's against the law here to broadcast anything that interferes with that frequency because the channel has to be left available at all times...
Does the US not have something similar? Chances are the law if you have one has not been updated to adhere to the modern world which might actually work in it's favour. And older law that specifically bans the blocking of frequency to prevent broadcast could still be implied that apple are blocking the frequency reaching the phones.
