Oddly enough, no. For wireless it's the carriers that control it and Apple just has to deem their devices as "not a compatible mobile device".

Yes, the carriers (Verizon, AT&T, etc) are legally bound to push out the alerts. Even if you turn the notifications off on your phone you will still get Presidential alerts. However, the agreement with the FCC only goes as far as the carriers and then its up to your device as to whether you can get them or not. If Apple were to actually go through with this though it would probably piss off more than just Trump supporters because that system is used for a lot of things that normies would most definitely want. Everything from amber alerts to weather events.
