Before invoking the powers under the Act, 10 U.S.C. § 254 requires the President to first publish a proclamation ordering the insurgents to disperse. As part of the Posse Comitatus Act of 1878, these provisions are now codified as amended.
If I recall correctly, the one time I accidentally heard Biden speak I heard him call it an insurrection. Either he messed up or it was part of the Democrats' plan to use the insurrection act themselves, and now President Trump can justify it with their own words.
