If the Vice President dies, resigns, or becomes President, the President can appoint a new Vice President. The appointment needs to be confirmed by a majority vote of both the House of Representatives and the U.S. Senate.
So technically he can, but that would need to assume he’d be arrested or something (thus resigning) in the wake of an IA invocation along with pretty much all of congress. Otherwise it wouldn’t pass.
Not to piss on the Pede parade here but the VP is an elected office, not a cabinet position. Trump can’t replace Pence any more than he could Pelosi.
