If it’s the counting of the EC votes in the Senate session, it seems pretty clear that the VP role is largely ceremonial. Him counting the Trump votes would be a conflict of interest, he’d be deciding his own continued employment.
Conflict of interest or not, he had a duty to acknowledge the competing slates of electors, which he refused to do, while also saying if there were any he had a duty to acknowledge them. He admitted his duty publicly, and then refused to do it.
