Saw several conflicting opinions including one from a circuit court judge. There is precedence going back to 1799. One opinion stated that it would ultimately be up to the Supreme Court to decide if the Senate has the authority to do so. Interested to hear opinions from fellow Pedes. No shills please. It has never been attempted before there has never been a reason. It would make sense the drafters intended it to be solely used to remove a sitting president not to punish one who left office. The impeachment language refers to the president, not a former president. There are other ways to punish a former president such as prosecution if he committed a crime in office.

Problem is we live in a post Constitutional era where logic, common sense, and established rules no longer seem to matter.

Go ahead, make Trump a martyr, he will only grow stronger. Now that there is more evidence of antifa coming out any Senate trial will actually help demonstrate the truth. Just keep in mind, none of this really matters. It is all theater. Our government has demonstrated that it is a worthless piece of shit, not worthy of the constitution.

At some point the amount of proof coming out makes the RINOS look incredibly foolish. I’m hoping there comes a point where they have to start acting with more reason. Time will tell.

I’m fairly certain they will convict. Democrats want to, and McConnell seems cooperative. His decision to start the trial on the 19th is less about protecting Trump and more about tying up Biden’s first days of legislation with an impeachment trial.

If McConnell can rally the Senate to convict, and I think he can, then they will do so after Trump leaves office.

It will inevitably end up in front of SCOTUS unless Trump and/or his allies doesn’t bother contesting it.

If the senate takes the trial in theory senators would be allowed to defend trump..... But democrats control the senate so they will goto a fast vote or say its too late to act. They do not want evidence being submitted
