They are hoping to nullify the charges of being unauthorized. This is different than someone saying the president told me to riot, be violent, or anything else. Let's remember, we just spent 8 months were laws related to trespassing, authorized access, etc have been suspended in the name of free speech - why would anyone think that if you can shut down a highway for 3 days or an entire city with zero legal ramifications that you can't enter the public grounds of the capitol, especially after the president said to go there. This in no way is saying that the president incited or encouraged violence or a riot. He was encouraging the exercise of freedom of speech. The democrats and the media set the ground rules for how that right can be exercised over the course of the last year.
