Because in that situation there is no crime. There is no suspect. People aren't psychic. There's no way to arrest on drug charges if they aren't there and purchasing. Otherwise, they'd be just walking up to some random and saying, "you're arrested" - "why?" - "because you might buy drugs one day"

I am well aware of that in the situation of someone robbing a bank but the standards for hanging someone for committing treason at the highest level via a military tribunal may very well require the crime to actually be committed.

Fact: one can be arrested for ATTEMPTING to commit a crime. There is literally nothing stating that crimes must successfully be completed before law can intervene. To persist that is the case is fucking retarded and you should be embarrassed.
I have never disputed that. YES, you can be arrested for attempting and for planning on committing a crime.
But this is not a typical crime, it would be going through military courts, and the punishment for treason isn’t your typical punishment...
If you were going to arrest someone (or a large group of people) for committing treason which could lead to them being sentenced to death... regardless of the truth in the evidence, you would still have a large faction of people who wouldn’t want to believe any of it...
Wouldn’t it make more sense to let the crime be committed to it’s full extent to have the strongest chance of keeping order among unbelievers during what would be a very volatile time

Here is the problem, if Trump arrests Biden now all hell will break loose. But if FEMA is in control because of a national emergency, i.e., foreign nations interfering with the election, then FEMA can arrest Biden, run military tribunals and run the country for a few month while a forensic audit of the election is done by the military.
Then declare Trump the winner.
You will still get riots but with half of the players in jail, they may be milder than the usual.
