TL;DR IMO whoever made the protest flyer had the source file from the election night flyer.

From what it looks like, these 2 images were generated from the same source file. (i.e. *.psd for photoshop, *.xcf for gimp) If you look at the flyer from election night, the statue of liberty in the background is partially obscured by the not only the "H" from the word "WATCH" but some random "V" shaped glyphs on the lower part. You could, get another image of the statue of liberty, run it through a few filters and recreate that background image of lady liberty. (And, that would show at a high enough resolution because the minute details in the duotone effect would be different. This is due to the software, it would clip it a little different as it broke the source image down to 2 colors. The point of what parts goto 1 color (dark) and the other color (light) could never be exactly matched. Matching the color values is a snap in software, but in an effect like doutone. What part of the statue is which color could not be exactly replicated and would be detected if the resolution allows.) But, this appears to be someone with access to the source file just wiping out all the layers on top on the background layer with the statue of liberty and then creating the new Protest messaging on top. Not just somebody creating the protest flyer out of an image or images like it.
