The problem with the justice system is not that it's too harsh or that it's racist somehow but that it's not harsh enough. You have to stop assuming you can fix these people. Most of them will never know any better than to be criminals.
Cutting them break upon break upon break only exacerbates the problem as they begin to see the law as a joke and believe they will never go to jail no matter what they do. This eventually culminates in them committing a crime like this, where someone is badly harmed or killed.
The proper solution should be to make examples out of them on the first or maybe second time and then every time. No exceptions for anything. The more time they spend in prisons, the less time they spend out causing hell and hurting people. And it also helps them, since not only do they destroy other lives they destroy their own. If they're in jail they're not able to rack up more arrests and have a longer record.
Another problem is today we have a whole subsection of society who thinks this criminal behavior is just fine, believes it is normal, and objects to any one coming in to stop this behavior. This is why we see riots when someone gets themselves shot or overdoses or what have you. Here again I don't see how you fix this.
We really need to step up punishment for lower level offenses but give people a path back to redemption. I would be for mandatory 7-30 jail sentences for minor offenses like shoplifting and first time DUI with an automatic expungement of the record after some time. If they don’t have a job after release they can be hired by the government into picking up litter, fighting forest fires, pushing beds at the VA, etc. until back on their feet.
