Assuming you're thinking about the emergency alert system.
The messages you get on your phone are transmitted through the Wireless Emergency Alert System. This system goes through the local cell towers, which AT&T likely control.
If they intended to block messages, they could do so at the tower. . . wouldn't have to push out any phone updates. . . though a phone update might be easier.
