It would involve the SCOTUS for sure, but 0% chance they would take this type of case.
There have been past elections where a fraud candidate has won, then a judge has removed the candidate and placed the real winner in office. This is rare, and for obvious reasons, the courts don't want that on them.
Probably not on the basis of a fraudulent election directly. Under a properly functioning government, he would resign or be impeached.
Here’s the problem: The President is chosen via the electoral college. The Electors Clause of the Constitution gives plenary power to the respective state legislatures to choose their electors however they see fit. This power may not be taken away by state or federal law or even by a state constitution.
If the state legislature wanted to choose by coin flip, so be it. If the state legislature wanted to use a statewide popular vote (which most states use), but then decided they did not like the result of that vote, the state legislature could ignore the vote and appoint the electors they wanted to.
The Texas lawsuit (which SCOTUS ducked on standing) argued (rightfully, IMHO) that the non-legislature branches of various state governments had altered the rules of those states’ elections, violating the electors clause.
However, when the legislatures of these various states approved of (or were silent about) the certification of Biden’s electors, they effectively ratified the actions of the non-legislature branches and effectively chose the Biden electors.
The state legislatures respecting the fraudulent votes resulted in legally appointed electors. He’s in there.
You’ll see people discussing a quo warranto action. I doubt this will work; Biden had the electors with the approval of the state legislatures.
Have heart; there could be (okay, there almost certainly is) some legal theory of which I am unaware.
My response is something of a summary, and is written while bearing in mind SCOTUS is cucked.
A tougher SCOTUS could create a new precedent (or fall back on the case that circulated here weeks ago, which pointed out that “fraud vitiates everything,” though that was dicta, not precedent). But imagine the problems such a ruling would cause: Biden (or more likely Harris by the time the case is heard) would or could ignore SCOTUS, and simply ask them who would enforce their ruling. The military and law enforcement apparatuses wouldn’t know what the hell to do.
