It's like the IRS truthers who try to go into tax court claiming that they aren't required to pay federal income taxes, "show me where in the constitution it says you are allowed to force me to pay income taxes", etc. They have their theories about which flag is being used in the courtroom, and how that proves that everyone who pays taxes does so voluntarily, so if you just refuse you can legally avoid paying all income taxes...
Bottom line, the men with guns are making the rules, and the constitution is only relevant if it helps them increase their power. Otherwise it is ignored.
