The media is not immune from lawsuits spreading misinformation, it is true. That's why your local news always say "Police have a suspect in custody" and not "Police found they guy who committed the crime".
Either they'll have no standing because it's not the media's fault they failed to accurately state what Biden would do when elected, or it'll be thrown out because it's moot; the damage is done and it isn't the place of the court to regulate the first amendment.
