I don't think they've thought it through (a hallmark of liberal policymaking), but the entire venture is impractical. How would they even collect those taxes? It would be impossible for someone to track their unrealized gains and losses across an entire year. Moreover, what's the measurement interval? If a stock goes up 50% at market open, but is back to even at market close, I had an unrealized gain of 50% at 8AM and 0% at 4:30PM. Which do I pay taxes on?

If they make it as "sell-rebuy every so often (e.g. annually)", it will adjust your basis to pay taxes when you actually sell.
