I added emphasis to the word "and". The word "or" could have been used, but it wasn't. The word is "and".
Snopes seems to be saying that since the CDC guideline doesn't require a mask in this situation (it's one of the exceptions), you can ignore the other parts of the "and" clause.
I'm not aware of court precedent that says we can treat the word "and" as if it was "or". If we suddenly change that precedent, I can imagine a lot of interesting things.
What, you think "yeah, there's a picture of him doing it, but what you see isn't what you really see" is a stretch? Pssh!
The thing they are "fact checking" isn't even someone stating a fact. It was someone asking a question and then sharing a photo!
