The secretaries of State all unconstitutionally passed law without going through the legislature. He could have kicked it back to the states to figure out, he didn't.
No he could not have. Congress as a whole could have, not him unilaterally. The law says the VP counts the votes. It does not say they pick which ones to count or have the power to send back to the states
