If pulled over or interacting with the police (detained or involved in a situation):

  1. Ask why am I being pulled over? Don't respond to "do you know why I pulled you over?"

  2. If the officer asks about your day, say you are not going to discuss your day.

  3. Ask the officer if you are being detailed or are you free to go?

  4. If the officer asks to search the vehicle or person openly state that you invoke your 4th amendment rights and clearly state that you do not consent to any searches.

  5. If the officer gets aggressive with you in terms of talking to you say that you INVOKE your 5th amendment right and shut the fuck up

  6. Comply with all lawful orders and don't do anything stupid. Even if the officer is openly violating your rights, don't resist. Your lawyer can use your rights being violated as a basis to get the case dismissed.

Oh yeah, and get the fuck off twitter and facebook. Anything you SAY or WRITE can and will be used against you in court of law.

You don't HAVE the 5th amendment right for a traffic stop.

Just like you don't have the right to refuse your license. You are REQUIRED to hand that shit over.

They pull you over, pull over. They ask why they stopped you, you answer politely that you don't know. They ask for your registration, license, insurance, you give it to them. No arguing or whining. You do it. If you don't have it, you admit you don't have it and he tickets/tows you for it.

You don't get to invoke your 5th when they're asking for your license/reg/insurance. You don't. If you want to throw a fit about it, do it in court. Not on the side of the fucking road.

You ARE driving. Not traveling. Black's Law Dictionary from 1903 isn't going to help you. All that's going to happen is you're going to bind them and yourself up and you'll be wasting time.

Saying you don't know miiiight get played against you if they later say you lied or were unaware or whatever. Usually if you avoid a straight answer and go; "Why DID I get pulled over?" with the 'no, I don't' unspoken but implied, you're safe.

The cop'll have to be a real dickwad to pull that kind of "Hey, he said he didn't know" crap but assume you're dealing with an asshole. YOUR job is to be as polite as possible and don't try to front as an "I know my rights" type unless pressed.

If the cop's a nice guy "muh rank and file" he's going to get annoyed at you coming at him like a bad guy.

If the cop's a power hungry asshole, he's going to be offended by you (rightly) pushing his authority and try to fuck you over however he can, and they're not above looking for a reason to take you in and then ranking up whatever they think they can get in court to make you pay to fight them just as a fuck you.

Be polite, be unassuming, and be as boring as possible, giving bland non-answers. You are Ned Flanders as played by Ben Stein, unless you're getting grilled enough you finally have no way but to ask if you're being detained and/or invoke the 5th.

My wife and I get warnings. Because we are upfront with what’s going on and not playing dumb or resisting.

This is not just in one town, but all over the state of Texas. I’ve pulled over immediately so quickly he barely got his lights on, and did a uturn. I did not make him chase me down the road. That got me a warning.

I’ve even driven 5 miles in the middle of the night in Oklahoma and got the “driver throw your keys out the window” because I took too long to pull over. I waited until it ther was a shoulder but he told me for him to worry about that in the future. Still got a warning.

Just be nice, what works for me may not work for you. My wife being blunt and like yeah I k now I was speeding, sorry I’m not used to the area or whatever works for her. They’ve appreciated the honesty.

Good comments, to continue, if they tell you to get out of the vehicle, you must comply AND they ARE permitted to body search you so whatever sh!t you have don't keep it in your pocket. Provided the officer doesn't see anything, he MUST ask your permission to look in the car and trunk and you DO have the right to politely decline his request. It's his move next. One thing you can count on is no matter how much you support the police, they will always follow orders no matter how stupid they are...the law, not the officers.

The problem is if you act out, they use that against you in court. Could charge you with a crime. Read up on the stories about situations where the police violated someone's rights. Often times, the evidence collected is tossed out. I've seen this happen many times with illegal car searches. The police search the car, find guns, drugs etc but the policed lacked probable cause for the search. Judge tossed all evidence out and dismissed the case.

To add to this even cops that would normally cut breaks or ignore something you said can't if they have a body cam. If they cut a break on say a departmental directive and the person makes a complaint even a bullshit one the cop will get rung up for not following policy. It happened to someone I know, he no longer cuts any breaks. This is more for car stops or summary violations both are possibly just tickets so it is totally up to the cop for now at least.

Different example would be like be like a vufa violation where if it is yours and a simple mistake that is a stupid ass law in the first place you could have been let go but if you admit to it on camera you are burnt.
