Why sue to get Robert's to preside, that makes no sense. Just ignore the whole thing. Have the Office of the Former President put out a statement saying that the trial is unconstitutional and therefore they will not participate. We know they don't have the votes either way. Just don't play.
We all know this is meaningless, as does Trump. And it does not stop him from running again. It's just a blatant kangaroo court to scare other "little people" out of trying to run for office themselves.
What we should be doing is lampooning it and showing our lack of fear.
I think Roberts is afraid he's going to be sitting in the chair when Trump's lawyers cite all the cases that he allowed to be dismissed, which threw this country into a Banana Republic, he himself is responsible for the Dems gaining control, he himself is responsible for a Liberal bunch of goons running our country like a damned communist country. He knows he has shit the bed
But that never bothered him before (See twisting the Obama Care Law, See not taking the cases where he knew these states violated the constitution etc. etc.) he is a Never Trumper, who my guess is looking back and saying, what the hell did I do, he's an ignorant fool who allowed the press to manipulate him.
He was acting within his mandate, we just didn’t like his decisions. This would be completely different. His like or dislike of Trump has nothing to do with this. It’s like if you asked him to sit in on your condo board meeting- he is not even going to respond.
The tricky part of that is the Senate can make up whatever rules it wants, and the rules are determined by a majority vote. That basically means Democrats can do whatever they want.
The only reason they haven't repealed the filibuster is that there are a few D holdouts refusing.
True, they do as they please. But SCOTUS is supposed to check them, and they would have to void the impeachment as it was done according to their arbitrary rules, going directly against the constitution. I don’t know how the fuck you would litigate when Congress and the Chief Justice of SCOTUS are both party to violating the constitution.
Exactly, but if Robert’s is supposed to preside, then Trump has a real case in court. The problem is that Trump would have to sue Robert’s and Congress. The only court high enough to hear such a case is SCOTUS, but how could Robert’s preside over his own trial? For that reason, I don’t think Trump has a chance litigating against this.
Honestly, Trump needs to do is go before the senate and directly challenge their authority to try private citizen Trump. If they cannot provide "standing" to try private citizen Trump, are they admitting he is the rightful president in exile, and that is why they are trying to impeach him?

Pretty much this.

In my family, we call this "Big Dicking It."

It would be improper for him to preside as the constitution is pretty clear. No way he is gonna do it for shits and giggles.

Theoretically, Congress can impeach anyone, even someone not currently holding an elected office or working for the Federal Government.
Congress could, if they wanted, impeach and convict me, and then I would be ineligible to run for a Federal office or work for the Federal government.
That's the whole point of this process. Trump would be ineligible to run in 2024, which is why 17 Republicans are going to vote against him.

Someone said either they recognize him as the president or they are plain stupid
