Not always legal. I live in FL which is a two party state. Any private conversations must have consent of both parties to be admissible. In fact I believe it's a felony to record without permission here. That's why it's so important to say 'this call is/may be recorded'

There’s typically really easy ways to get around that tho.

“I was planning on taking notes on the conversation after”

Or if your attorney approaches the judge with “we literally have them on tape doing the thing” the judge will normally allow it anyway

Not really. Many times the second party needs to acknowledge. Trust me. I've looked into this. Unless both parties are clearly informed something is being recorded, it's inadmissible in court.

With that said, public conversations are fair game. The rule of thumb is... if there's a reasonable expectation of privacy, you must inform it's being recorded. Such as a phone call.
