Us claiming it's illegal is not an action, just a belief. Beliefs aren't going to physically alter the reality that an illegal regime is sitting in power at the moment.

If the elite class can develop the means of quickly disappearing anyone who begins to emerge as a leader then we'll flounder and never accomplish anything past localized riots.

The conflict right now is all about a battle of wills.
They are trying to assert that their crimes didn't happen and that they are legit.
