Any Lawyers Out There that Know About Power of Attorney That Could Answer a Quick Question Please...
My Dad wants me to give him Power of Attorney and then give him the paperwork. I own my own home. Would that give him power to sell it right from under me if he wanted to. What nefarious (if someone wanted to be) things can someone do with a power of attorney. I appreciate your time.
Uh, yeah. WTF would you give anybody that power over your life?
Not a lawyer but DON'T DO IT. if you're healthy and sane don't do it. Power of attorney give someone else complete power over your life.
Yes, you're right. I will not do it.
Ask for an explanation. This for no reason is fucked. He could mortgage your home, his home, etc and you’d be on the hook
He's trying to get me to move and sell my house. He was helping me financially after my husband passed away. I am healthy and my kid will be 18 in two years. I am only putting things in my kid's name.
Yeah something fishy here...i'd ask a lawyer for some advice on this
You can make someone your POa for very specific things. I would not give someone POA over possessions unless I was going to prison.
Exactly my point. I think my Dad is trying to have something to hold over my head. I am Not doing it. He has threatened to cut me off if I don't do it. Oh well, am not falling for it.
He can even admit you to an insane asylum if he wanted to.
And especially if you don't trust him, dude, I'm asking, WTF, dude?
That's the Crazy part!!
You don't have to be a lawyer to know that it's crazy to even consider it.
Yeah, completely insane. Not falling for it. I read that you especially don't give them the paperwork because then they can start abusing it.
Why on earth would you give POA to your dad?
I’m in Australia so it may be different here, but the language of a POA here also includes when it becomes active, and you can just tick the box that says “when I’m incapacitated and unable to make decisions for myself”.
But I agree with the others, sounds sketchy - I wouldn’t do it. Or if I did it I wouldn’t give the paperwork to him, I’d give it to my lawyer to hold. And it’s not normal for kids to give POA to parents, it’s usually the other way around.
Bottom line - get legal advice. Because the answer to your question is yes he could sell your home, POA lets him do anything in your name.
Thank you
NAL: talk to a local lawyer before you do anything, but there could be differences in the way a POA can be set up—i.e. springing or non-springing. Just look it up so you can ask all the right questions to your attorney and answer his.
Thank you
Sounds like he only helped you to get his hands on your home. Don't do it. You do not owe him anything unless you signed a written contract with witnesses and notarized. If you don't have a contract for what money he helped you out with, you do not owe him anything.
Ya don't do that.... Epstein had power of attorney from Les Wexner and did all types of shady shit.......
POAs can grant extraordinary rights. rules differ by state. don't song anything without consulting an attorney.
