One suggested possible defense: "There were NO signs VISIBLE to me that said anything about Tresspassing". Any signs that could have been posted were almost certainly obsurred by other people, not posted at right height, missing by the time you got there to walk on public property, etc. Anyone who prefers to read and speak in Spanish, German, Italian, or other languages would also have added defense arguments.
Short fences do not, in of themselves, imply "no admittance" unless also accompanied by proper signage, and/or sufficient officers to tell each and every one there of the change in policy about visiting the Capitol building.
These arguments are in addition to those put forth by others.

I don’t think anyone has been arrested for just being past a fence and on the lawn...yet anyway. I think that would be an entirely bogus charge, based on your points, but you never know what the future holds. It would be kind of hard to argue that you didn’t know you couldn’t walk into the building though. On the other hand, I’m suspecting the people who went inside peacefully may get off easy. They gov knows, based on your points, trespassing will be hard to prove with the doors already opened. That’s why they’re adding extra charges. They can cut a deal for a minor conviction. Just my opinion. I think the violent ones will be the ones getting the major shaft, to make an example.
