I would actually not say that. That is not as easily defensible (regardless of whether it should … we let that train leave the station a looooong time ago). What is defensible is that after you actually talk to ta doctor and consult with an employment attorney (even if it is just a consultation on the limits of HIPAA and whether he is a true believer or knows that the government is overreaching and tyrannical) that you will not comply on the grounds of medical privacy.
