So standard procedure is for the judge to hire his own prosecutor to continue the case and invite anyone to submit amicus briefs right?

It’s a dismissal without prejudice. The government is theoretically free to refile it.

However, that does not stop a private individual or group of individuals from filing their own lawsuit over the same thing

Theoretically, sure, but you usually don’t drop a case you intend to pursue.

My guess is that this case is dead. The current DoJ agrees with the policy, they have no reason to want it changed.
