Why can't someone ask the fucking SCOTUS if this is legal. File a lawsuit against the entire Congress. Keep it tied up in the courts and keep Congress spinning their wheels for 4 years fighting it.

I've been wondering this too. Why is there not even an attempt at using their strategies against them by bogging them down in legal bullshit for years?
On the one hand, maybe Justice Roberts didn't (or didn't only) choose not to hear the case because of its unconstitutionality, but also because if he did so, he would have to recuse if the Trump lawyers brought the case's constitutionality to the supreme court. Maybe they know that he chose not to hear this case because he has enough support in SCOTUS to kill any challenge brought to them.
On the other hand, word is that Trump's attorneys are planning to not bring fraud evidence into the case. This is a serious misjudgment, because Rand Paul has already gotten enough senators to state that it's unconstitutional; they are locked in now. It is therefore an open opportunity to bring the evidence before the American people, and (if the news is true,) his lawyers are advising not to do so. Such bad strategy.
Trump should still file a lawsuit against every single Congress member who proceeded with this unconstitutional act in their home states. I'd go the civil route to seek monetary damages.
