They should be sued. I've yet to read a warning label that it should "Not to be used as a hair spray."
Personally, I'm gonna sue scissor manufacturers: no warning label "Don't run with scissors."; knife manufacturers: "Don't play with knives."
Was gonna sue chainsaw manufacturers for "Don't attempt to change blade while machine is running", but I found it in the instruction manual IN LARGE PRINT.
