I've read the articles and still fail to understand how it's in any way legal to trespass on private property without a warrant, let alone set up cameras to monitor the owners, whether it's a 6000 sq ft lot or a 6000 acre ranch.
Because judges have eroded the 4A in the name of War on Drugs. They arrested a guy for removing the GPS device the police attached to his vehicle. More or less the only place you have true 4A is in your home with the doors locked with you never leaving and that is still no guarantee they can't find a way to get a warrant for some bogus shit.
I know the case you're talking about, and not that I agree with that by any stretch either, but one could at least make the logical conclusion that it was placed there by authorities. How the hell is a property owner supposed to know some unmarked trail cam belongs to the state wildlife agency? If it had been me I would've just assumed poachers, probably like they did. And the state's reaction is to SWAT the owner when they justifiably take it down? I'm hardly a legal scholar, so maybe I need an "intellectual" to explain to me how this is in any way Constitutional.
Yeah, it is a word salad when they explain why a cop can trespass or if they can't go that route they will use game wardens to gain 'access' it is retarded but they have done this many times before or like the DEA using the illegally obtained cell records and text messages but create the case around different evidence so as to not expose the NSA.
Outside of some exigent circumstance I still don't get it. If it's really that pressing of an issue, obtaining a warrant shouldn't be any problem, so why the cloak and dagger? What I do understand all too well however, is that our government seems to be able to do whatever the hell it wants with zero repercussions or regard for the laws they're tasked to uphold.
