Ah, you missed the actual answer.

The prosecution said they weren't aware of those remarks and that they couldn't imagine the Vice President encouraging violence.

The defence expressed astonishment at that, as they'd shown the clip three times already that day as part of demonstrating that it's protected political speech that fails to meet the incitement test.

More relevant to the question was whether treating Trump's words as incitement would create a precedent that would allow impeachment of Harris.
