Correct. A judge has actually already ruled on it. But what the judge basically said was “yeah, it’s unconstitutional for women not to be drafted, but my ruling cant change that, congress needs to pass a law to make it happen”. Which, of course, never happened.

Sounds like the judge needed to strike the law down as unconstitutional rather than just saying “but you know I don’t write the laws around here”
