You can't recall a senator. A quick search on the internet would reveal that.

Slugbert 76 points ago +76 / -0

It's been proven time and time again recently that laws/rules don't matter anymore.

If the Utah State Legislature passes this bill they can recall him.

Highlighted Provisions: This bill: ▸ defines terms; ▸ establishes a process for legal voters to petition to place a question on the ballot to recall a United States senator; ▸ describes the signature requirements for a petition to recall a United States senator; ▸ addresses forms, timelines, processes, and requirements for an application for recall, preparing and circulating recall petition packets, and verifying and certifying signatures; ▸ addresses a recall ballot question, voting, and canvassing votes; ▸ establishes recall election dates; ▸ provides for legal review of certain actions; and ▸ establishes criminal penalties for misconduct relating to the petition, and related processes, to recall a United States senator.

If you live in Utah you should keep that going.

21
FireannDireach 21 points ago +25 / -4

The only problem with that, is the Congress is a Federal entity, so the Constitution is the overruling authority. There are no provisions in it to recall anyone from either house, and attempts at it from state to do so have been shot down, and SCOTUS has not ruled definitively that it's possible.

https://ballotpedia.org/Laws_governing_recall

If Utah passes this, Romney can sue all the way to the SCOTUS. I don't think it's a slam dunk like you think it is.

29
jedmeyers 29 points ago +30 / -1

the Constitution is the overruling authority.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

It would be a very interesting case to argue States don’t have authority to remove their own Senators if there are no provisions for it. No provisions -> “reserved to the States respectively, or to the people”

18
Cincinattus1776 18 points ago +18 / -0

Yes, and the method to remove a sitting congressmen from office is spelled out in the Constitution.

Article I, Section II, Paragraph V: "Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member."

14
edflyerssn007 14 points ago +14 / -0

Thats "A" method, but why wouldn't people be allowed to recall their own senator?

10
BigIronBigIron 10 points ago +10 / -0

For a time, the public didn't get a choice over their senator in the first place.

10
Morokei 10 points ago +10 / -0

Which proves you can change procedures.

Constitution doesn’t say you can’t recall a Senator and since the federal government is silent perhaps the power has been reserved to the states

1
edflyerssn007 1 point ago +1 / -0

Since Senator selection was turned over to the people, recall should be available as well.

It's called the second amendment eh

4
FireannDireach 4 points ago +5 / -1

The issue - as I understand it, mind you - is that once elected to Federal office, states have no authority over them at that point - they're no longer a state elected official. The case I read about was over term limits, and SCOTUS said states can't change or add any rules or laws that aren't in the Constitution.

And, for the record, I want recall powers, I'm just going by what I've read.

It would be great if Romney took this to the SCOTUS and lost, but I'm not sure SCOTUS would want to hear this. The Constitutionalists would just say "Not in the Constitution, sorry, you'll have to amend the Constitution to do it."

8
IvIA6A 8 points ago +8 / -0

Another reason to repeal that bullshit amendment that took powers away from states to choose their senators

5
FireannDireach 5 points ago +6 / -1

Constitution needs a lot of overhauling, and certain key issues decided on by SCOTUS. But not with the current pack of corrupt shitheads in power. I don't want either house going near it, with the current rosters.

2
infojunkie07 2 points ago +2 / -0

problem is when you start overhaul in present time, the DEMS will want 2A and other things overhaued as well.

“The constitution is the overruling authority”

Uhhh are you sure? Pretty sure I just watched thousands of politicians wipe their ass with that piece of parchment last month. The constitution is absolutely worthless now, no longer being respected and enforced.

6
Belleoffreedom 6 points ago +6 / -0

Let him sue, then. How humiliating is that?

7
FireannDireach 7 points ago +8 / -1

Would be interesting to watch. If they can get SCOTUS to uphold recalls, that would for sure change the political landscape. Congress members are too secure without it.

3
Big_Al_42223 3 points ago +3 / -0

You’re dense if you think being recalled by voters even if it doesn’t result in removal won’t irreparably wreck his reputation, cause major legal issues, and guarantee his re-election loss.

5
JohnParker1 5 points ago +5 / -0

It's about time.

23
We_Are_Inevitable 23 points ago +23 / -0

Can easily change with a single house vote.

20
Austin62Halo 20 points ago +20 / -0

Could they vote create new laws to also recall him.

19
TrumpWonBigly2020 19 points ago +19 / -0

That's what they are trying to do.

3
BunkerHill 3 points ago +3 / -0

No, not unless they revise the constitution.

12
CisSiberianOrchestra 12 points ago +13 / -1

Yep. Only way to remove a senator is through expulsion, which requires a two thirds majority.

11
ChuckedBeef 11 points ago +12 / -1

So relying on other hacks who stole their way to power instead of letting the people decide. Wonderful system we have. Fool the people or steal your way in and there is literally ZERO fucking recourse.

This shit has to end now.

I like the message, but Utah doesn't have a real recall process and I don't think this will go anywhere. It sends a message, but the Utah GOP is stuck with him until 2024.

24
sully 24 points ago +24 / -0

Utah legislature is trying to pass a state law that allows a recall process for Senators.

They don't have a process, but they're going to create one.

2

You can’t recall senators because they’re federal— not state. What they can do is bar him from re-election.

COLDWARPATRIOT55 0 points ago +3 / -3

It’s a Mormon school. Not about Jesus much

5
bananaguard62 5 points ago +6 / -1

Uh, what? Mormon is short for The Church of JESUS CHRIST of Latter Day Saints. We have the same relationship with Christ that other Christian faiths have, but we also have the BoM, which says on its cover, another testament of Jesus Christ. It's the record of people in America and their prophets testifying of a savior. It records Christ's visit to the people in this land after he was crucified. We are, like, all in on the Jesus game.

3
ParticleCannon 3 points ago +3 / -0

Why would anyone in Utah vote for him? Is it voter/election fraud, primary rigging, or what?

12
FromSethWithLove 12 points ago +12 / -0

Kind of. Utah came up with this process of getting around the convention by getting signatures. People didn't realize it only means rich guys who lose the convention can pay a signature-gathering company to get them into the primaries. Mitt lost the convention but used this new law to get into the primaries. Mike Kennedy was his opponent, also very mormon, so that's not it. Normies vote for the name they recognize, plus, Trump endorsed him as an olive branch.

If you've ever heard the quote "you'll never regret being nice" that's bullshit

Senators can't be racalled,

Now I know people are trying to change that, but The senate would have to approve and they won't

Might focus on nuking them in the 2022 primary or try recalling some of these out of control Governors. Fredo for example (Cuomo but he hates Fredo, so Fredo it ever shall be) maybe Whitmer, (what happened to her recall petition? I never heard more about it) Newsom, (Now this one IS gaining momentum) And the other 2 dem dipshits that put covid patients in nursing homes and killed them.

1

We can recall Mitt, we can impeach him, we can expel him, we can put him on trial for the treason. We should do it. We just need to set up some Zoom meetings with judge, juries, and lawyers and talk together and make a judgement and announce that Mitt has been impeached, and recalled and given a death sentence.

1
Mean_MAGA_Facka 1 point ago +1 / -0
