Because that’s the case OP was referring to and only the Texas Attorney General, Ken Paxton, was going to argue this case before the court, which some help from Ted Cruz. That would have been so epic, especially with all the briefs of support from 10-15 other states.
Barrett, Kavanaugh, and Gorsuch had an opportunity to be courageous and they didn’t. Trump has acknowledged this himself. Their inaction in a direct-jurisdiction Article III case made everything fall on Pence, who was assuredly ready with the shiv.
