Pence failed to use his legal power to reject invalid electors and accept alternate electors.

Trump failed to use his legal power to invoke the Insurrection Act. The same results under the IA were immediately used against Trump. He didn't invoke the act because optics. Leftists didn't care about optics - they still have thousands of soldiers surrounding DC.
