My assumption is that wrong clothing/bedding material lead to hypothermia and death, probably in conjunction with lack of energy from food.
A $120 zero degree working sleeping bag and a camping stove with a few $5 green propane cartridges would have been all that was needed to survive together with 4000 kcal/day in noodles or rice/fat.
Too bad no-one checked with this family,too.
The storage space, yes, but a lot of these people do not own any of that potentially live saving equipment. They rely 100% on services by others. This suit will go nowhere because they will claim force majeure and they have a point.
This does not excuse the lack of winterization.
They would all be alive if the family huddled together for warmth. My guess is that the parents and kid drank thinking the booze would keep them warm and instead the kid died of hypothermia in his sleep while the parents kept each other warm.
Booze prevents frostbite, but it increases the risk of hypothermia. And booze also increases the chance your kids will die.
Don't know the exact circumstances and that's why it is difficult to say what was the issue.
But even in single digit temperatures you don't need to die if you know what to do.

I have been here in Austin, and there were so many places for people to find warmth if they were actually dying.
Now, I have also suffered from hypothermia before, not this time, and so I know that it makes you go crazy. Actually, losing your mind is one of the first symptoms after lethargy. So I know how easy it is to die from it. But I would expect parents to get the adrenaline pumping if they see their kid's lips turn blue. The parents were asleep at the wheel. And quite possibly, the kid was intoxicated because even a kid would know that they are dying. When I had hypothermia as a kid, I had the morose feeling that I was dying. Thankfully my dad recognized that we needed heat soon and got us some heat sooner than he had planned. Maybe he was just smart, but I also think he had an instinct as a parent that I wasn't right. And partially I was acting different on purpose because I felt like I was dying.
Long story short, there were resources all over Texas to stay warm. All you had to do was ask. And our bodies naturally respond to these incidents to prevent our own demise. There had to have been negligence on someone's behalf for this kid to have died. And by someone, I mean someone who was in his immediate vicinity or should have been in his immediate vicinity.
It won't bring that boy back, but I also feel retaliatory about this particular story. Especially if they would not increase capacity and all the other stories I keep reading. But I'm not sure what's true in this situation and what's folklore. That poor, poor family. It's so sad.
It smells fishy to me. The boy died but the toddler next to him survived? I've seen a lot of terrible lawsuits, it honestly wouldn't surprise me if he died for some other reason and the family sued for money. The biggest plot twist is if they killed him themselves for the money and national attention.

I routinely sleep with a window open. Just shorts, sometimes a shirt too. Cold fronts have come over night dropping my inside room temperature to below 45F which wakes me up to close the window and get more bedding.
And how did the toddler next to him remain alive? I would assume the toddler's body temperature would drop more quickly then his. Sad all around for that little boy, but I'm not sure we're getting the whole story.
Exactly. The adults had to have abandoned their kid for this to happen. They are more likely to be charged with criminal charges of endangerment or homicide than they are likely to get a dollar out of the power companies.
There were so many shelters with heat that they could have put their kids in. And lots of ways of getting heat.

I don't really understand how you die in that temperature unless you took no measures. Like hell start the car every 20 minutes for 5 minutes and sleep in there if you have literally no other source of heat...
