The problem with the Constitution is that it is a document, not a living, breathing entity. An oath only works insofar as there are people who will enforce and uphold their oath. Countries are made of people with a common heritage, language, religion, and oftentimes, race (see Federalist #2). They are, and never can be, fully functional solely on "ideas" like the left and the GOP claim America is. America is its people. The people are not expendable and replaceable like cogs in a machine.

If there is ever another society built from the ashes of this one, say after a civil war, I'd hope we look to the original constitution for inspiration, look back and remove what was and and include what was good which the founders might not have thought of, and then make it so that it can never be amended.

Almost carved in stone, so to speak. Live with it, die with it. This is how it is.

Otherwise you get endless degradation as societies morals decay and their corruption increases.

There was a lug-nuts case in Michigan a few months ago where the Supreme Court of Michigan ruled that because the proper service of the tire rotation on a vehicle was started, it could be defined as properly completed and thus was immune from any shoddy word done, such as not finishing the job in the first place resulting in the wheels falling off the vehicle fifty feet down the highway.

So, if an armed mugger rapes a Supreme Court justice, it can't be tried because it happened in the past and it's moot.

Okay, if some crazy shot a Supreme Court justice, it would be only a moot past event and not open to judgement.

What do you do when the courts become criminal? When justice is denied because the judges distort the law? The system is dysfunctional and it has to be fixed. When the republic becomes a banana republic it is time to peel some bananas, find the rotten ones, and deal with them. When the banana republic dictator surrounds himself with 20,000 guards it has become time for the people to rise up.

If I was ever brought up on charges, I would cite this SCOTUS decision as precedence for my trial being moot. Can't argue with precedence. Punishing me isn't going to bring my murder victim back, or unsteal the thing I stole. Sure, you could make me give the thing back, but then that would be stealing from me, and that's wrong.
