For many states swing or the legislature delegated those powers away long before any of the current legislatures were born. So part stems back generations and now that it mattered most they either wouldn't or couldn't do anything in time. If you recall some states wanted to decertify on Jan 6th but governors wouldn't let them into session until about the 5th.
